Overview

Insurance companies assign adjusters and investigators to your claim immediately. They are actively trying to minimize your claim. You need an attorney who is working to maximize your claim.

The biggest mistake people make when involved in an auto accident is waiting too long to obtain treatment and too long to consult with an attorney.

Insurance companies look for any reason to deny a claim. If an individual is injured in a vehicle accident, they must seek medical treatment. It becomes imperative for them to consult with an attorney to gain a better understanding of how to document their injuries. Delaying the assessment of injuries without medical intervention for several weeks can result in significant consequences. Similarly, postponing the consultation with an attorney can lead to financial repercussions. It is important to note that evidence and witnesses may disappear over time, while the memories of police officers involved in the incident may fade.

Attorney Chris Clem has dedicated himself to assisting injury victims through Chattanooga and Southeast Tennessee. I have more than 30 years of experience. I represented insurance companies from 1993–2006. I know exactly how insurance companies work and how to maximize the value of your claim. This law firm has recovered tens of millions of dollars for our clients.

Should You Pursue an Auto Wreck Lawsuit?

Though you’ve already suffered your injuries, you may be wondering whether you’ll have the opportunity to pursue your personal injury claim. There are 2 key issues in every claim. Who is at fault? And, how much are the damages? Our clients are most frequently involved in the following types of accidents:

  • Motor vehicle wrecks
  • Motorcycle wrecks
  • Wrecks with tractor trailers

If the kind of accident you were injured in is not listed above, that doesn’t necessarily mean our firm won’t represent your claim.

Contact our office as soon as possible so we can discuss your claim in greater detail and determine whether your claim warrants a personal injury claim.

The TN Statute of Limitations for Personal Injury

State law requires car accident victims to act promptly if they want to receive compensation after a collision, as a lawsuit must be filed within one year of the incident or the court may dismiss the case. This deadline, often referred to as the statute of limitations, is established by Tenn. Code Ann. §28-3-104(a)(1)(a). Many car accident cases settle out of court, but if the insurance company knows the statutory deadline has expired, the company will have no incentive to pay a settlement, which is why it is wise to adhere to the time limit set by the state.

Total Recovery of Your Personal Injury Damages

The ultimate goal with any personal injury claim is to recover full compensation for every single loss you’ve endured at the hands of the person who is liable for your damages. An injured individual can recover compensation for economic or noneconomic damages, which are either ones with a value that can be calculated, or intangible losses with a real impact on a person’s well-being but no direct monetary equivalent. Damages could be awarded for consequences such as:

  • Hospital bills
  • Permanent impairment to the body
  • Lost wages due to time missed from work
  • Reduced earnings anticipated in the future
  • Future medical treatment, including therapy
  • Pain and suffering
  • Emotional anguish
  • Loss of enjoyment of favorite activities
